Mr. Alspaugh specializes in patent portfolio management, copyrights, trademarks, and licensing issues for clients in a wide range of industries, including medical device, consumer products, sports, software applications, and automotive. He serves as an instructor of Biomedical Business and Legal Management Essentials at the University of California, Irvine Extension, where his course is required for a Regulatory Affairs Certification from the University. His clients range from start-ups to well established corporations, both domestic and international. He has substantial experience in the preparation and prosecution of both U.S. and international patent applications.
Mr. Alspaugh serves as General Counsel for various corporations in California. In that capacity he provides counseling on corporate structure, compliance, regulatory, and he conducts IP due diligence in preparation for mergers and acquisitions and/or venture and capital investments.
He frequently counsels clients on patent strategy, infringement issues, and intellectual property due diligence. He authors opinion letters regarding patent invalidity and non-infringement. Mr. Alspaugh also represents clients in the preparation and/or negotiation of contracts including: licensing contracts, non-disclosure agreements, collaboration agreements, consultation agreements, and SEC filings.
Mr. Alspaugh received his Bachelor of Science degree in Biology from the University of California, San Diego. In the years following he worked as a research associate developing in vitro diagnostics and pharmaceutical treatments in the fields of ophthalmology, cardiology, dermatology and orthopedics. He also participated in clinical trials in the US, Europe, Asia, and South America.
Mr. Alspaugh has experience preparing investigational new drug applications, Class II 510K applications, Class III investigational device exemptions, and all aspects of cGMP implementation for drugs, medical devices, food, cosmetics, nutraceuticals, and dietary supplements.
Mr. Alspaugh received his J.D. from the University of San Diego, School of Law in 2004 and is a member of Phi Delta Phi, an international legal fraternity. While in law school, Mr. Alspaugh worked as a patent agent and a law clerk at Haight Brown and Bonesteel LLP, a full service litigation and business transaction firm. Mr. Alspaugh was then recruited to serve as patent counsel for Biosensors International, Inc., a medical device company traded on the Singapore Stock Exchange, specializing in the manufacture of innovative drug eluding heart stints. He has successfully launched two new corporations that developed new drug eluting stents and bifurcation catheter technologies.
Mr. Alspaugh is very involved in the Orange County Medical Device Community. He is a member of the Orange County Bar Association; DeviceAlliance, an industry association focused on medical devices; and OCTANe, an Orange County technology industry association. Mr. Alspaugh also volunteers his expertise to numerous non-profits in the fields of animal rescue, STEM education, green technology, arts, and medical device. Mr. Alspaugh also serves on the board of numerous private companies.
